These Terms of Service (“**Terms**”) govern your access to and use of the website **www.goodeatseveryday.com** (the “**Site**”) and the purchase of products sold on the Site under the brand **GoodEat**. The Site is owned and operated by **Cafe Nutrition** (“**we**”, “**us**”, “**our**”).

By accessing, browsing, or placing an order through the Site, you agree to be bound by these Terms and our Privacy Policy (available on the Site). If you do not agree, you must not use the Site.
## 1. Hosting Platform
The Site is hosted on Shopify Inc. (“Shopify”), which provides us with the online e-commerce platform to sell our products. Your use of the Site may also be subject to applicable third-party terms (including payment gateway providers and logistics partners) to the extent required for providing services.
## 2. Eligibility
You represent that you are competent to contract under applicable laws in India. If you are under 18 years of age, you may use the Site only under the supervision of a parent or legal guardian.
## 3. Product Information (Food Products)
1. We make reasonable efforts to ensure that product descriptions, images, pricing, and other content on the Site are accurate. However, images are for representation purposes and actual packaging may vary.
2. Information on ingredients, nutrition, allergens, storage, and usage instructions may be displayed on the Site and/or on the product label. Where there is any discrepancy, the information on the product label should be treated as authoritative.
3. Our products are intended for general consumption. They are not intended to diagnose, treat, cure, or prevent any disease unless explicitly stated in accordance with applicable law.
## 4. Allergens, Storage, and Safe Consumption
1. Our products may contain or be processed in facilities handling common allergens. Please read ingredients and allergen information carefully before consumption.
2. You are responsible for ensuring that products are suitable for your dietary needs and for following all storage and consumption instructions.
3. If you have allergies, medical conditions, or dietary restrictions, you should consult a qualified professional before consuming any product.
## 5. Orders, Acceptance, and Cancellations
1. Placing an order constitutes an offer to purchase. An order is considered accepted only after we confirm the order and/or dispatch the products.
2. We reserve the right to refuse, cancel, or limit quantities of any order in our sole discretion, including for reasons such as suspected fraud, inaccuracies in pricing or product information, stock unavailability, or non-serviceability of the delivery location.
3. If we cancel an order after payment has been received, we will process a refund to the original payment method within a reasonable period, subject to bank/payment gateway timelines.
4. If you request cancellation, such cancellation will be considered subject to whether the order has already been processed or dispatched. Cancellation requests must be raised immediately by emailing info@cafenutrition.com. If the order has already been dispatched, it may not be eligible for cancellation.
## 6. Pricing, Taxes, and Payments
1. All prices are displayed in Indian Rupees (INR) unless stated otherwise and are subject to change without prior notice.
2. Prices may be inclusive or exclusive of applicable taxes (including GST) as indicated at checkout.
3. Payments must be made through the payment options available on the Site. By placing an order, you authorize us and our payment service providers to process the payment for the total amount payable.
## 7. Shipping and Delivery
1. Shipping timelines shown on the Site are estimates and may vary due to operational constraints, courier delays, weather conditions, or other factors beyond our reasonable control.
2. Delivery will be made to the address provided by you at checkout. You are responsible for providing complete and accurate address and contact details.
3. Risk of loss transfers upon delivery to the provided address. You should inspect the package at the time of delivery and promptly report any issues as per Section 8 below.
## 8. Returns, Refunds, and Replacements (Food Items)
1. **No Returns:** Because our products are food items, we do not accept returns or exchanges once an order has been delivered.
2. **Exception (Damaged or Spoiled/Defective):** A replacement or refund may be considered only if the product is:
- damaged in transit (e.g., torn/leaking/opened packaging, broken seal, or materially compromised product), or
- spoiled or defective in composition at the time of delivery (e.g., abnormal odor/taste, visible contamination, or unfit for consumption when received).
3. **How to Report:** If you believe your order qualifies, you must email **info@cafenutrition.com** as soon as possible with:
- order number,
- product name(s),
- description of the issue, and
- clear photos of the product, outer packaging, and label/batch details (if available).
4. **Resolution:** After verification, we may offer a replacement or refund, at our discretion and in accordance with applicable law. Please retain the product and packaging until the issue is resolved.
5. **Non-Eligible Cases:** Refunds/replacements will not be provided for change of mind, taste/texture preference, incorrect address provided by you, delays attributable to the courier after dispatch, or normal variations consistent with natural ingredients.
## 9. Promotions and Discounts
Promotional offers, discount codes, and campaigns are subject to separate terms (if any), validity periods, and stock availability. We reserve the right to modify or withdraw promotions to the extent permitted by law.
## 10. User Conduct and Prohibited Use
You agree not to:
- violate any applicable law or regulation;
- interfere with or disrupt the Site, servers, or networks;
- attempt unauthorized access to any portion of the Site;
- submit false, misleading, or fraudulent information;
- infringe our intellectual property or the rights of others.
## 11. Intellectual Property
All content on the Site, including but not limited to text, images, logos, product names, designs, and trademarks, is owned by or licensed to Cafe Nutrition and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or exploit any content without our prior written consent.
## 12. Disclaimer and Limitation of Liability
1. To the maximum extent permitted by applicable law, the Site and products are provided on an “as is” and “as available” basis.
2. We do not guarantee uninterrupted or error-free operation of the Site.
3. To the maximum extent permitted by law, Cafe Nutrition shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from use of the Site or purchase/use of products.
4. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
## 13. Indemnity
You agree to indemnify and hold harmless Cafe Nutrition from and against any claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms, misuse of the Site, or violation of any law or rights of a third party.
## 14. Privacy
We collect and process personal data in accordance with our Privacy Policy and applicable Indian law. By using the Site, you consent to such processing as described in the Privacy Policy.
## 15. Grievance Redressal (India)
If you have any complaint, concern, or grievance regarding the Site, products, or services, you may contact our Grievance Officer at the details below. We aim to acknowledge complaints within **48 hours** and to resolve them within **one month** from the date of receipt.

## 16. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. The courts at **Mumbai, Maharashtra** shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, subject to any mandatory dispute resolution requirements under applicable law.
## 17. Changes to Terms
We may revise these Terms from time to time. The updated Terms will be posted on the Site with a revised Effective Date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
